The Ministry of Justice Friday asked Hanoi to reconsider its recent regulations on slaughtering, transporting and trading poultry and cattle, saying parts of it are “baseless”.

The regulation, which took effect on Monday, bans people from transporting poultry and other livestock on motorbikes, bicycles and pedicabs. They are also not allowed to transport the animals into the city center either.

Le Hong Son, head of the ministry’s bureau for testing legal documents, said the bans were “somewhat baseless.”

He also said the regulation, which was issued on January 22 by Hanoi People’s Committee, includes orders that are “impractical at present.”

This could cause people to do whatever they want, he said.

According to the regulation, abattoirs must be built under the committee’s approval, have separate storing and slaughtering sections, a place for workers to clean themselves, a standard waste treatment plant and waterproof flooring.

Cattle and poultry product stores should be at least six square meters large and booths at the market at least three square meters, with the meat products placed on stainless steel, enameled tile or quality wood not lower than 0.8 meters from the floor.

Experts have agreed these rules can help prevent dangerous epidemics like avian influenza, mouth-and-hoof and blue ear diseases but argued they don’t suit the country’s current conditions.

Bird flu has killed 52 people in Vietnam since 2003, while the highest toll in the world has been recorded in Indonesia with 113 fatalities.

A milder than usual U.S. flu season is masking a growing concern about widespread resistance to the antiviral drug Tamiflu and what that means for the nation's preparedness in case of a dangerous pandemic flu.

Tamiflu, the most commonly used influenza antiviral and the mainstay of the federal government's emergency drug stockpile, no longer works for the dominant flu strain circulating in much of the country, government officials said Tuesday.

Of samples tested since October, almost 100 percent of the strain -- known as type A H1N1 -- showed resistance to Tamiflu.

In response, the Centers for Disease Control and Prevention issued new guidelines to physicians in December. Doctors were told to substitute an alternative antiviral, Relenza, for Tamiflu, or to combine Tamiflu with an older antiviral, rimantadine, if the H1N1 virus was the main strain circulating in their communities.

Each flu season, several types of flu viruses circulate, and various ones can dominate in different regions and times. Only the H1N1 virus is showing signs of Tamiflu resistance, CDC officials said, speaking at an influenza conference in Washington.

Other flu viruses currently circulating are not Tamiflu-resistant.

Each year, the three most prominent flu strains -- two type A's and one type B -- are chosen for the creation of the flu vaccine. Unlike last year, both of the A viruses matched this year's vaccine, although the B did not, officials said.

Public health experts recommend flu shots as the best way to avoid the virus.

Health officials have long urged constraint in using antivirals out of fear that, as with antibiotics, misuse could lead flu viruses to develop a resistance, rendering the drug ineffective when it was truly needed.

Tamiflu, which is known generically as oseltamivir, and Relenza, or zanamivir, came on the market 10 years agoand were hailed as being more effective at treating the flu and having fewer side effects than the older antivirals rimantadine and amantadine. They were also lauded as being much less prone to develop resistance.

Tamiflu and Relenza have been stockpiled by the federal government for treating the public in case of the emergence of a dangerous pandemic flu. Four times as many Tamiflu doses have been stockpiled as Relenza doses.

Some microbiologists have argued that Tamiflu is more likely to develop resistance than Relenza. Therefore, they say, Relenza should make up at least 50 percent of the stockpiled antivirals.

"There have been people, and I'm one of them, that have suggested that there be more of an equal stockpiling of oseltamivir and zanamivir," said Dr. Anne Moscona, a pediatrician and professor of microbiology and immunology at New York-Presbyterian Hospital/Weill Cornell Medical Center.

Tamiflu became the more popular drug because it can be taken orally in pill or liquid form, whereas Relenza must be inhaled and can't be used by young children or the elderly.

What mystifies infectious disease experts and microbiologists is the Tamiflu-resistant strain now circulating appears to be a mutation that spread naturally, not as a response to antiviral use.

"We don't think it's due to overuse," said Dr. Anthony Fiore, a CDC epidemiologist. "There's not as large amount of use of oseltamivir as there might be with antibiotics."

Influenza viruses are ribonucleic acid-based, which are error-prone when replicating. This means they change rapidly, Fiore said. If a change occurs that confers an advantage of some sort, then it's likely to be passed on.

Viruses also swap genes among themselves, and one fear is the resistance mutation will be passed on to other flu viruses, including the deadly H5N1 bird flu circulating in Asia.

For now, H5N1 responds to Tamiflu, although it must be administered early. The virus is more than 60 percent fatal in humans.

China has insisted there are no bird-flu outbreaks in China, despite eight human cases in January alone this year. But experts fear the tide of death washing out of southern China shows that China is once again covering up another major public health catastrophe. It happened before in 2003, when Beijing denied the existence of the deadly condition that became known as Severe Acute Respiratory Syndrome - or SARS - until it had crossed the border into Hong Kong where it went on to spread worldwide infecting thousands and killing hundreds. It happened again last year when state newspapers were initially ordered to keep quiet about a scandal which lead to many thousands of young children falling sick and seven dying after drinking baby milk tainted with the chemical melamine. According to the World Health Organization (WHO), China has recorded a total of 38 bird-flu cases since the disease resurfaced in 2003, including 25 deaths. Five people died in China of bird flu in January alone, two more than in the whole of 2008. Three other people were infected. So far more than 20 dead birds have been found on Hong Kong beaches within the last week. Six of the birds have so far tested positive for the H5N1 virus strain. However, there are no current outbreaks in Hong Kong nor are there any farms close to the sites where the infected birds were discovered. Together, these facts are causing concern in Hong Kong which boasts arguably the world's most stringent bird flu detection and prevention measures, introduced after 1997 when the former British colony witnessed the first modern incident of the virus crossing the species barrier when it infected 18 people of which six died. Hong Kong Secretary of Health Dr York Chow confirmed Thursday the birds are most likely to have drifted down from the Pearl River in southern China sometime over the last week. He also said that tests on the dead birds detected a strain of H5N1 previously found in southern China and not Hong Kong. Leading Hong Kong bird-flu expert and chairman of the Hong Kong Medical Association, Lo Wing-Lok said all these facts indicated that "something very terrible" could be happening in China. That is the wrong way round and is quite worrying," Cordingley said. "Quite clearly there seems to be gaps in the surveillance of wild birds and poultry in China. We don't know what these gaps are and it may not be sloppy surveillance. But from a human health point of view, we are concerned. "If people are to stay safe and healthy we need to know where the virus is and the evidence is that in China at the moment, people don't know where it is."
